    U.S. Judge Rules Federal Gay Marriage Ban Unconstitutional



    The federal law banning gay marriage is unconstitutional because it interferes with the right of a state to define the institution and therefore denies married gay couples some federal benefits, a federal judge ruled Thursday in Boston.



    U.S. District Judge Joseph ruled in favor of gay couples' rights in two separate challenges to the Defense of Marriage Act, known as DOMA, a 1996 law that the Obama administration has argued for repealing. The rulings apply to Massachusetts but could have broader implications if they're upheld on appeal.



    The state had argued the law denied benefits such as Medicaid to gay married couples in Massachusetts, where same-sex unions have been legal since 2004.



    Tauro agreed and said the act forces Massachusetts to discriminate against its own citizens in order to be eligible for federal funding in federal-state partnerships.



    The act "plainly encroaches" upon the right of the state to determine marriage, Tauro said in his ruling on a lawsuit filed by state Attorney General Martha Coakley. In a ruling in a separate case filed by Gays & Lesbian Advocates & Defenders, Tauro ruled the act violates the equal protection clause of the U.S. Constitution.

    Libers have been saying this for a very long time.. Nice to see that the law is starting to listen.. Interesting that they used the 10th amendment to make this ruling.. Conservatives have been screaming for decades about state rights.. Especially states like Texas.. Well.. It is about damn time that amendment was used against them about an issue they do not like..



    I am happy for this ruling!! We shouldn't be descriminating against our own people on any issue..

    As a simple prediction.. I am guessing that not to many conservatives or christians are going to respond to this thread.. First, they can't argue with Fox News which is why I used that source instread of some other.. I am sure if I used Huff post or something they would bitch and complain the article was fake some how or a lie..



    Another reason would be that I am quite certian that not to many of the right tards like me here.. Which frackly I don't really give a shit about at this point..



    And last but not least.. There is now a court ruling that says descrimination of gay marriage is unconstitutional.. While they may try to argue with it.. They really can't.. Especially since it uses one of their fav amendments to use in reguards to other issues..



    But, on the same token.. They love to makes themselves look stupid and hypocritical.. So??

    Nobody says you have to.. You are entitled to that belief..



    But on the same token, nobody else has to live in accordenance with your beliefs either..



    I will simply say that your reasonings, while based on religion alone are unfounded and based on hypocrisy.. Unless you accept the entire OT and live by all of the laws.. You are a hypocrit to not agree with gay marriage.. Christians do not have the luxary to pick and choose what parts of the bible like and and don't like.. The simple fact that you do, rendors your opinion and beliefs meaningless to everyone else except yourself..

    secular courts can say what they want .. but that doesn't make it right

    I'll be taking your gun now since you have no respect for the constitution, I am sure giving up your 2nd amendment right is no issue for you.. Since god's law doesn't give you the right to bare arms..

    The ruling,if it stands, removes gay marriage from federal jurisdiction. It is therefore a victory for state's rights and removes the issue of gay marriage from the idea of universal rights that are federally guaranteed.
