They aren't, they may be checked by the police if they are engaged in a regulated activity on a public street where the police are charged with keeping drunk drivers off of.
You may suppport driving drunk, I don't and society doesn't and will take steps to ensure people who are driving, a licensed regulated activity on a public street, are not under the influence.

Everytime the police arrested someone driving under the influence, everytime someone says, I better not have another drink, there maybe a roadblock out tonight they do.
So if we take your position why not just get rid of DUI laws, if they kill someone we can just charge them with the higher offense of murder, or if they just harm someone charge them with assault.

No they aren't, go read the court decissions. If you operate you car on your own property then fine. But once you go out on a public street you must be licensed by the state and they can regulate your activity.
