Do you mean under the constitution as it was meant to be for a very long time or after it became bastardized with federal income tax legislation and federalist legislation, etc.?
I would include any gov spending or program that goes against the spirit of the constitution as it was written and intended to be written for the first hundred years or so. So for example, slavery was intended to be eliminated so anti-slavery laws are consistent with the spirit. A federal government that is more powerful than the states and dictates to them what they should do is not consistent with the Const.
Take public education as an example too. The states technically run the educational system. But in practice the fed taxes all the citizens of the states and then returns the money to the states only if they run the educational system the way the fed wants it run. It is within the letter of the law but against the intent or spirit of the law.

The 16th Amendment was never propertly ratified.
There is not one SINGLE law that requires anyone to file an income tax return.
That then ripples down through the States, in terms of the unfunded mandates and so on.
Repeal the 16th, and you've taken a big step in terms of restoring the balance of Powers.

I agree that the 16th is a bad amendment. Income tax was allowed before it but it was not feasible.
The supreme court upheld the 16th. It is law of the land just bad law.
