    Guidence for Sotomayor Confirmation

    Should this be the guidance Senators use?

    1. Can a qualified judicial nominee set aside her personal views and decide each case on the facts and the merits alone? That decisions ultimately have to be based on evidence and on facts. They have to be based on precedent and on law.

    2. That speeches and papers should not demonstrate a history of judicial philosophy of overreaching.

    the first one for sure. the second one is iffy.

    it would seem that a judge would be penalized for writing a paper or giving speech, that expresses personal views, not ideas or opinions that would necessarily be used in a judicial setting.

    Finestein certainly, Sessions and Hatch were quite good and stated their position very succinctly. Didn't hear the others, could only catch parts here and there.

    Only those that express an overreaching judicial philosophy.

    I am not trying to jack the thread but the libs need to know something about this scum. She supports abortion to get rid of undesirable races. I would think about that!!

    By the time I got back, an hour later, the opening statements are still going on.....what the hell.....

    By the way has anyone noticed how similar dick cheney and patrick leahy look alike?

    justice is supposed to blind

    ethnicity, culture,, and empathy are not cognizant to a ruling... only what the law says is to be considered..... If sotomayor things that you make policy from the bench or that she is supposed to use her empathy in rulings she is wrong.. she is going to be appointed unless she does something or says something that will change the senates mind.. I only hope though that the other socous menbers will overrule her when she tries to go beyond the law and legislate from the bench..
