Mukasey agress, prosecutions for torture now hard to avoid.
Mukasey Cites Risk in Using Term 'Torture' - WSJ.com“WASHINGTON -- Attorney General Michael Mukasey raised concerns that government agents and national security lawyers may be at risk for criminal prosecution after his likely successor, Eric Holder, declared that waterboarding of terror detainees is torture.”
“The 67-year-old former federal judge in New York, who took office 14 months ago, said in an interview that the incoming administration of President-elect Barack Obama faces a ‘conundrum’ as it tries to shut down the prison at Guantanamo Bay, Cuba.”
“Word that Mr. Obama plans to issue an executive order to close the prison has caused worry among Justice Department lawyers who fear evidence backing the cases against many of the approximately 250 detainees wouldn’t hold up in a conventional court proceeding.”

its not good precedent for one administration to have criminal proceedings against a previous administration.
Remember, half the reason why democracy is good is because there is a peaceful change in power. Start down this road, who knows where you'll end up.

Besides, you shouldn't prosecute lower level officials who engaged in acts of torture, because obviously it involved the higher ups. And, you can't really go after the higher ups, because there is nothing in the law that says torture is illegal, and if Obama puts something in the law to that effect, it will be EX POST FACTO. Another unconstitutional prosecution.

I still don't think its good precedent to prosecute previous administration members.
I guarantee you, that if something big happens during the Obama presidency, and he something is needed to be done that could be questionable, he will authorize things that are not totally legal or totally moral, contrary to his rhetoric.
That's the "MO" of the Bush regime....torture the English language to turn a crime into something else.
Torture = Enhanced Interrogation
By that thinking, how about these:
Bank Robbery = Non-standard Withdrawal
Murder = Population Pruning
Kidnapping = Rendition
Treason = Shock & Awe
