Thread: New Secretary of State appointment unconstitutional

Ive seen this bouncing around the internet. I may be missing something but according to Article 1 Section 6 of the US Constitution Hillary's appointment is unconstitutional. Not tha Barak's next appointee would be any better but I would love to see her appointment challenged.

I think that she just has to resign before being confirmed. The same for Obama.

I dunno...I'll be pretty bummed if they stop her appointment and find out Obama isn't a US citizen! **crosses fingers**

Personally I think douchbags like her would do a great job in that positon.

All that means is that she has to resign from the senate.

This might be just the thing to get Palin out of the national limelight forever! I say go for it.

Nope, it's nonsense.

The Red Queen will resign from the Senate, be appointed by the Obie, and figure out a better way to rake in cash than she's been able to as Carpetbagger From New York.

She hasn't been appointed yet. The Obie isn't president and has no power to appoint anyone. These are all prospective nominees, is all.

Glad you're on board.

What I had earlier, in regards to the un-Constitutionality of her appointment, is that no-one may be appointed into a position in which they voted to give that position a raise in pay. In other words, as a Senator, she helped to increase the pay of the position she is now accepting. That, is un-Constitutional.
What I also heard in the same story, is that this is not un-precedented. I don't remember the who's or the when's, but what they did to circumvent that is to Pay the incoming appointee what the salary was prior to the increase.
While that does not make it any less un-Constitutional, that is what has happened in the past and what will probably happen now.
