    Does anybody have an opinion about this?

    In order to avoid construing the enumerated rights in a manner that denies or disparages unenumerated rights, courts should instead ask whether governments actually have the power to enact the law being challenged. Force government to justify its powers, instead of citizens to justify their rights, and the Constitution will work as written.
    It came from a post regarding the SCOTUS.

    Any thoughts?

    He's just being a whiny little ass about the fact that his party was crushed this election. I doubt his filibuster tactic will do anything except annoy a lot of people.

    i think its sad how people are jumping all over obama and he hasn't even been sworn in yet. i think it really exposes the rift between obama, who ran on a platform of bipartisanship and working together and being united, and the people who just want to be right, no matter what, all the time, and are unwilling to bend in the slightest.

    I was really more interested in what people thought about this part:

    I do not know how you could force government to do that with congress and the judiciary the way it is but if we had a president who would stand up for the people it would be conceivable, as it should be.

    How do you say "judicial review"? The power and process to do exactly what is described in already active and in place.

    Given that the world's not all neat and tidy, just what part of the Constitution has stopped working?

    Actually, there is another aspect of the question at hand, and that is when the violation of rights or misuse of powers is flagrant or obviously illegal. Citizens should be able to have courts assess officeholders guilty of such misconduct massive penalties. Too many cases exist where misconduct in office is protected from any penalty other than cease and desist.

    I agree its frustrating. We see just a few of the hardcore deadenders here though, the rest of the country (normal people with lives who don't hang out in political forums) dosen't seem to be showing any buyers remorse. There will be ups and downs during Obama's administration but I believe overall Obama will do alot to try to mediate the rancor that has been going on for the last 16 years.
