Should it? I think it should. It prevents people from hiring who they want. For one thing, if a white guy happens to be more qualified than the black guy, the black guy gets hired/enrolled. Also, if the employer happens to be racist, then he has less choice since he can only choose whites while the non racist employer can choose who he wants and drive the racist employer out of bussiness. The free market is the best example of affirmative action you will find.
